Muscat: His Majesty Sultan Haitham bin Tarik today issued a Royal Decree No. (41/2024) on promulgating the Law on Advocacy and Legal Consultancy, after presenting the same before the Council of Oman.
Article (1) stipulates that the Law on Advocacy and Legal Consultancy attached to this decree shall be enforced.
Article (2) states that the Minister of Justice and Legal Affairs shall issue the executive regulation of the attached law, as well as the decisions necessary for the implementation of its provisions. Till such time, the existing regulations and decisions shall continue to be enforced without prejudice to the provisions of the attached law.
Article (3) states that existing advocacy offices, civil advocacy firms and foreign legal consultancy offices shall adjust their status within one year from the date of enforcement of the attached law. The registration of non-Omani advocates shall continue to be valid until the end of this period.
It also stipulates that existing civil advocacy firms, if they are acting in partnership with a non-Omani partner, shall continue to operate for a period of three years from the date of enforcement of the attached law
During this period, non-Omanis are prohibited from abandoning the firms or any of their shares in favour of non-Omanis. The registration of a non-Omani partner shall continue to be valid until the end of this period.
Article (4) cancels the Advocacy Law issued under Royal Decree No. (108/96), as well as all that contracts this Royal Decree or the attached law or contravenes their provisions.
Article (5) says that this decree shall be published in the Official Gazette and enforced after six months from its date of issue.
